These Terms of Use ("Terms") govern your access to and use of the website Omakar.com and the mobile application Omakar available on Android and iOS platforms (together, the "Platform"), owned and operated by Bedrock Retail LLP, a limited liability partnership incorporated in India under the LLP Act, 2008, having its office address at 18302 Prestige Lakeside Habitat, Varthur Road, Gunjur Village, Bangalore 560087 ("Company", "we", "us" or "our").
The Platform enables users to digitize their temple experience, including live darshan and aarti streaming, temple discovery, and booking of pujas performed on their behalf by verified temple priests ("Services"). By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and any additional terms referenced herein. If you do not agree to these Terms, please do not access or use the Platform.
This is an electronic record generated by a computer system and does not require any physical or digital signature. These Terms are published in accordance with the Information Technology Act, 2000 and the rules made thereunder, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as amended from time to time.
1. Eligibility
1.1 By using the Platform, you represent and warrant that you are at least 18 (eighteen) years of age and capable of entering into a binding contract under the Indian Contract Act, 1872. If you are below 18 years of age, you may use the Platform only with the involvement and consent of a parent or lawful guardian, under their supervision.
1.2 You represent that all information you provide to us during registration or otherwise is accurate, current, and complete, and you agree to update such information as necessary to keep it accurate, current, and complete.
2. Your Account
2.1 To access certain features of the Platform, you may be required to register for an account using your mobile number and complete a one time password (OTP) verification. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2.2 You agree to notify us immediately at support@omakar.com of any unauthorized use of your account or any other breach of security. The Company will not be liable for any loss or damage arising from your failure to protect your account credentials.
2.3 We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, if we believe you have violated these Terms or engaged in conduct that we deem harmful to the Platform, other users, or any third party, including temples and priests associated with the Platform.
3. Description of Services
3.1 Live Darshan: The Platform provides access to live streamed darshan and aarti from temples that have partnered with the Company. Live streams are dependent on the respective temple's schedule, internet connectivity, and other factors outside the Company's control, and we do not guarantee uninterrupted or error free streaming at all times.
3.2 Puja Booking: The Platform may allow you to request that a puja or ritual be performed on your behalf at a partner temple by a priest associated with that temple. By booking a puja, you authorize the Company to coordinate with the relevant temple and priest to arrange the performance of such ritual in accordance with the details you provide.
3.3 Offerings and Payments: Any offering, dakshina, or payment made through the Platform for a puja or donation is passed on to the relevant temple, subject to applicable payment processing charges, if any. The Company does not claim ownership over any offering made through the Platform. Details of applicable charges, if any, will be clearly disclosed to you before you confirm a payment.
3.4 Temple Directory: The Platform provides information about partner temples, including their history, timings, and rituals, as supplied to us by the respective temples. While we take reasonable steps to verify this information, the Company does not guarantee that all information is accurate, complete, or current at all times.
3.5 The Company reserves the right to modify, suspend, or discontinue any Service, in whole or in part, at any time, with or without notice, and shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
4. User Conduct
You agree not to, and not to permit any third party to, use the Platform to:
a. violate any applicable law, statute, ordinance or regulation;
b. impersonate any person or entity, or misrepresent your affiliation with any person or entity, including any temple or priest;
c. upload, post, or transmit any content that is defamatory, obscene, offensive, or that disrespects any religion, deity, or religious practice;
d. interfere with or disrupt the Platform, its servers, or networks connected to the Platform;
e. attempt to gain unauthorized access to any portion of the Platform, other accounts, or computer systems connected to the Platform;
f. use any automated means, including bots, scrapers, or crawlers, to access the Platform without our prior written consent;
g. use the Platform for any fraudulent or unlawful purpose, including making false puja booking requests or fraudulent payments.
5. Intellectual Property
5.1 All content on the Platform, including but not limited to text, graphics, logos, the Omakar name and mark, icons, images, audio and video clips, and software, is the property of the Company or its licensors and is protected by applicable intellectual property laws in India.
5.2 You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use, subject to these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Platform without our prior written consent.
5.3 Any images, video, or media of temples, deities, or rituals made available through the Platform remain the property of the respective temple or the Company, as applicable, and are provided solely for the purpose of enabling darshan through the Platform.
6. Temples, Priests and Third Party Services
6.1 The Company partners directly with temple trusts to provide live darshan and puja booking Services. While we take reasonable care in selecting our temple partners, the Company is not responsible for the acts or omissions of any temple, priest, or their staff, including the manner in which any puja or ritual is performed.
6.2 The Platform may integrate with third party service providers for payment processing, cloud storage, analytics, and communication. Your use of such third party services may be subject to their respective terms and privacy policies, and the Company is not responsible for the practices of such third parties.
7. Payments, Refunds and Cancellations
7.1 All payments made through the Platform for puja bookings or donations are processed through third party payment gateways. The Company does not store your card or banking details.
7.2 Cancellation and refund requests for puja bookings will be considered on a case by case basis, taking into account the timing of the request relative to the scheduled ritual and any commitments already made to the relevant temple or priest. Specific cancellation and refund terms applicable to a particular puja will be shown to you at the time of booking.
7.3 Donations and dakshina made through the Platform are generally non-refundable once transferred to the relevant temple, except where required by applicable law.
8. Disclaimers
8.1 The Platform and the Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non infringement.
8.2 The Company does not warrant that the Platform will be uninterrupted, timely, secure, or error free, or that any live stream will be available at all scheduled times, given the Company's reliance on temple partners and third party infrastructure such as internet connectivity.
8.3 The Company makes no representation regarding the spiritual efficacy or outcome of any darshan, puja, or ritual performed or facilitated through the Platform. The Platform is a means of enabling access to and coordination of religious practices and does not itself perform any religious function.
9. Limitation of Liability
9.1 To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Platform or Services.
9.2 The Company's aggregate liability arising out of or relating to these Terms or the Services shall not exceed the amount paid by you to the Company, if any, for the specific Service giving rise to such liability in the six months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
11.1 You may stop using the Platform and request deletion of your account at any time through the Platform's Settings, or by writing to us at support@omakar.com.
11.2 We may suspend or terminate your access to the Platform, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, temples, or priests, or is otherwise harmful to the Company's interests.
11.3 Provisions of these Terms that by their nature should survive termination, including but not limited to intellectual property, disclaimers, limitation of liability, and indemnification, shall survive any termination of these Terms.
12. Governing Law and Dispute Resolution
12.1 These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
12.2 Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the courts at Bangalore, Karnataka, India.
13. Changes to these Terms
The Company reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting of the revised Terms on the Platform. Your continued use of the Platform following any such change constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

11.1 You may stop using the Platform and request deletion of your account at any time through the Platform's Settings, or by writing to us at support@omakar.com.
11.2 We may suspend or terminate your access to the Platform, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, temples, or priests, or is otherwise harmful to the Company's interests.
11.3 Provisions of these Terms that by their nature should survive termination, including but not limited to intellectual property, disclaimers, limitation of liability, and indemnification, shall survive any termination of these Terms.
12. Governing Law and Dispute Resolution
12.1 These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
12.2 Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the courts at Bangalore, Karnataka, India.
13. Changes to these Terms
The Company reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting of the revised Terms on the Platform. Your continued use of the Platform following any such change constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
